YouTuber says SEC will recommend dropping lawsuit over 2018 token ICO
Ian Balina, CEO of Token Metrics and a popular YouTuber, stated that the US SEC plans to recommend the dismissal of the lawsuit against him regarding the promotion of Sparkster (SPRK) tokens in 2018. This development comes after the SEC allegedly reassessed its priorities following administrative changes under President Trump. The initial complaint claimed Balina failed to disclose a 30% bonus he received when purchasing SPRK tokens during their ICO. Despite previous court rulings determining SPRK tokens qualify as securities, Balina’s legal team indicated a willingness to appeal. As of now, there has been no formal motion from the SEC to drop the case. Balina noted the significant financial burden of legal fees stemming from the SEC’s enforcement actions, indicating he wished the regulator had not prioritized cases like his. The SEC's potential decision aligns with its recent trend favoring crypto entities, having ceased investigations into several others since Trump's appointment of new leadership in the agency.
