SEC hacker counters prosecutors with 366-day sentencing recommendation
Defense lawyers have recommended a prison sentence of 366 days for Eric Council Jr., the hacker who posted a fake message suggesting the SEC had approved Bitcoin exchange-traded fund listings. This filing, made in the US District Court for the District of Columbia, counters prosecutors' demand for a two-year sentence. Council, who initially pleaded not guilty, changed his plea to guilty in February for conspiracy to commit aggravated identity theft and access device fraud. The judge in the case, Amy Berman Jackson, has requested further details from prosecutors on the hacker's crimes before the May 16 sentencing. The filing argues that a sentence of just over a year would satisfy justice by sufficiently punishing Council while promoting respect for the law and deterring future misconduct. Prosecutors emphasized the sophisticated nature of Council's scam, which reportedly netted approximately $50,000 through similar SIM swap attacks.
