Prosecutors in the case against Tornado Cash developer Roman Storm are resisting a motion to compel evidence disclosure that may aid his defense. The issue revolves around whether prosecutors violated their Brady obligations by not sharing communications with FinCEN related to the Samourai Wallet case. In this previous case, FinCEN officials indicated they did not consider Samourai Wallet a money transmitting business under their guidelines. However, prosecutors argue that the FinCEN conversation does not need to be disclosed as it is opinion-based and irrelevant to Storm's case since it does not specifically address Tornado Cash. They claim no similar communications about Tornado Cash exist and contend that the cases operate quite differently. The prosecution's refusal to disclose this evidence raises concerns for Storm's legal team, yet they maintain that their actions comply with legal requirements. The trial against Storm is set to commence on July 14 in New York.
