A federal judge has ruled in favor of Thomson Reuters in its lawsuit against AI developer Ross Intelligence, concluding that Ross unlawfully copied data from Thomson Reuters' Westlaw platform. U.S. Circuit Judge Stephanos Bibas revised a previous ruling on fair use, determining that Ross failed to prove its defense. The case arose from a 2020 lawsuit where Ross was accused of using content from Westlaw to train its AI, after being denied a proper license. It was found that Ross obtained training data from a vendor, LegalEase Solutions, which compiled legal queries that closely resembled Westlaw headnotes. Judge Bibas identified that Ross infringed on 2,243 headnotes, dismissing defenses such as innocent infringement and copyright misuse. The judge emphasized the importance of recognizing when one is wrong, illustrating a shift in perspective based on new information brought to light in the case.
