The US Internal Revenue Service (IRS) has requested an appeals court to dismiss crypto founder Rowland Marcus Andrade's appeal against summonses for his financial records. The IRS asserts that it followed financial privacy laws during its investigation into Andrade's company, ABTC Corporation, for potential financial reporting violations. Andrade contends that he was not properly notified about the summonses, a claim rooted in the Right to Financial Privacy Act (RFPA). The conflict began in 2021, with the IRS issuing summonses to banks in May 2023. Although Andrade alleged a violation of his financial privacy, a district court ruled in May that the IRS had complied with notification requirements. Andrade then appealed in August, seeking to halt the IRS's access to the records while the case is still pending. The IRS's legal brief emphasized that Andrade was not entitled to damages or attorney fees as there was no statutory violation. The Fifth Circuit court now must decide whether to hear Andrade's appeal and examine the district court's ruling.
