These changes come amid ongoing discussions in Congress regarding legislation to clarify the SEC's and the Commodity Futures Trading Commission's (CFTC) jurisdiction over digital assets, including the CLARITY Act. Recently, the SEC has begun withdrawing previously proposed rulemaking notices related to crypto, indicating adjustments to its regulatory approach. The SEC remains understaffed, with one vacant commissioner seat, while the CFTC has multiple vacancies following significant departures. Efforts to appoint leadership for these regulatory bodies are underway, but no nominations have been confirmed yet.
